Revolutionary Kommerce Private Limited (“Company”, “We”, “Us”, “Our”,and “Ourselves”) operates and manages the e-commerce tab ‘Scapia Store’ (“Online Store”) integrated within the platform operated by Scapia Technology Private Limited (“Scapia”) and accessible at the web based platform www.scapia.cards and their applications on the android playstore and iOS Appstore and available to all Users within such platform (“Scapia Platform”). We place the utmost importance on maintaining the confidentiality, integrity, and security of your (collectively, “You”, “Your”, “Yourself”, and “Users”) personal data and information that You may provide while accessing and using the Online Store and the services provided by Us therein, which includes any information that You may provide to Us enabling Us to provide specific support that You may require from Us (collectively “Service(s)”). Our comprehensive Privacy Notice (defined below) reflects this commitment, which We encourage You to read fully.

This document (“Privacy Notice”) explains how information, including Personal Information (defined below in Section 1.1), is collected, received, stored, processed, disclosed, transferred, dealt with, or otherwise handled by Us in connection with the Service or otherwise through the Online Store. This Privacy Notice is incorporated into and subject to Our [Terms of Use / Terms and Conditions] (“Terms”) and shall be read harmoniously and in conjunction with them. This Privacy Notice is governed by one fundamental principle - maintain Your trust and confidence when handling Your Personal Information. Our Privacy Notice broadly lays out the following:

  1. The kind of Personal Information that We will collect from You, and the purpose of the collection of such information.

  1. Your right to choose what Personal Information You provide to Us and how such information is used. We collect and process Your Personal Information to provide and improve Our Services. We will also offer You an explicit opt-out clause, and We will stop processing Your Personal Information. However, please note that We may only be able to provide You with Our Services if You provide Us with the requested information.

  1. The circumstances where We disclose Your Personal Information to third parties and the manner in which such third parties may utilise Your Personal Information, such as third-party sellers (“Sellers”) and service providers who support Us in providing the Services.

  1. The practices and procedures adopted by Us in ensuring the privacy, security, and confidentiality of Your Personal Information when sharing such data with third-parties.

Our efforts of protecting Your Personal Information by maintaining appropriate security measures / protocols, that may include, physical, electronic, and procedural safeguards as per Indian laws. We will train Our employees to handle Personal Information properly. When We use other companies to provide Services for Us, We require them to protect the Personal Information We receive from You.

  1. How We handle Your information when You visit the Online Store, receive emails, SMSs, and WhatsApp messages from Us.

This Privacy Notice does not cover information You may provide to third-party websites, applications or services that are not owned or controlled by Us. This includes third parties We advertise on the Online Store or otherwise or on social media sites where We have a profile. This includes, but is not limited to, communications over third-party messaging platforms, such as WhatsApp. Such information will be governed by the privacy policies of respective third parties, and such sites.

Please note: This Privacy Notice does not apply to any services or websites operated by Scapia or to any information You provide directly to Scapia. Scapia’s handling of personal data is governed by its own privacy policies. Further, this Privacy Notice also does not apply to third-party platforms, services, or websites linked through the Online Store or displayed on the Scapia Platform, which are governed by their respective privacy policies.

  1. Personal Information Collected

  1. Personal information is any information about an individual if such individual is identifiable by such information, or in relation to such information. While We have, in Section 4 of this Privacy Notice, specified the exact data sets that We will collect from You (collectively “Personal Information”) along with the purpose of collection, We have laid out below broadly, the nature of Personal Information that We will be collecting from You:

  1. Name, mobile number, email address, delivery address, and other contact information;

  1. Financial information;

  1. Payment and transaction-related information, including billing details, payment instrument details, and transaction history

  1. Account and authentication details, including username, encrypted passwords, and security tokens as may be required to access the Online Store through the Scapia Platform;

  1. Details provided as part of placing or fulfilling any purchase requests placed by You on the Online Store for goods made available by Sellers (“Orders”), including preferences, delivery instructions, and communications with Us or Sellers;

  1. Identity documents and / or details provided by You to Us to avail the Services from Us and in connection with such Services;

  1. Access to camera and microphone, from time to time;

  1. Access to device storage, from time to time;

  1. User communications, including emails, chats, or calls with Our customer support team, or with Sellers facilitated through the Online Store; and

  1. Device-related and technical information, including current location, device type and settings, IP address, operating system, browser type, cookie identifiers, and other similar technologies that may enable identification of Your browser or device.

  1. On what grounds do We process your Personal Information?

  1. Consent: In most cases, We will process Your Personal Information based on Your prior explicit consent as required under Indian law, which You can withdraw at any time. In the event, You do not wish for Us to process Your Personal Information for any specific purpose, You retain the right to deny consent to Us for Use of Your Personal Information for such purpose. You may do so by contacting us at care@safareo.com. Please refer to Section 4 below to understand the different instances in which We collect Your Personal Information and the purposes for which We process Your Personal Information. While You have the right to withdraw the consent that You have given, certain Personal Information may be necessary to make available Our Online Store and/or provide You with Our Services and We may not be able to provide You with. Please note that certain categories of Personal Information may be essential for Us to operate the Online Store and deliver the Services. In such cases, if You choose not to provide such information, or withdraw consent for its processing, We may be unable to offer You access to specific Online Store features or complete Your Orders.

Notwithstanding anything contained herein, We may, in compliance with applicable laws in India, process Your Personal Information without obtaining Your consent in the event: (i) You voluntarily provide Your Personal Information to Us and do not indicate anything to show that You do not consent to the use of such Personal Information by Us. Specifically, this will involve situations when You fill out a form to (a) contact Us;  (b) for return or replacement processing; (c) for offers, giveaways, or referral programs. It also includes situations such as (a) logging in via the Scapia Platform to access the Store and voluntarily providing information such as delivery address, payment info, preferences, etc; (b) in-app chats; (c) emails to support, or call-back requests; (d) submitting product feedback or uploading images; (e) surveys or feedback; and (f) post-purchase satisfaction or product-quality surveys. Further, if You voluntarily provide Your Personal Information to Us for any of the purposes stated above, We shall not process Your Personal Information for any of the other purposes, unless You specifically voluntarily provide Your Personal Information to Us for any and / or all of such other purposes; (ii) the purpose of processing is for fulfilling any legal obligation to disclose any information to the State or any of its instrumentalities subject to such processing being in accordance with the provisions regarding disclosure of such information in any other law for the time being in force; (iii) it is for employment purposes or for defending Ourselves from any loss or liability in the context of employment; (iv) it is for compliance with any judgment, decree, or order issued under any Indian law or any judgment, decree, or order relating to civil contractual claims under any foreign law; (v) it is for responding to a medical emergency involving a threat to life or immediate threat to Your health or of any other Users’ health; (vi) it is for taking measures to provide medical treatment or health services to You or any other User during an epidemic, outbreak of disease or any other threat to public health; (vii) it is for the purpose of taking measures to ensure safety of, or provide assistance or services to, any individual during any disaster, or any breakdown of public order; and (viii) it is in the interest of prevention, detection, investigation or prosecution of any offence or contravention of any law for the time being in force in India.

  1. Information belonging to children and persons with disability

  1. The Online Store is not intended for use by children (i.e., individuals below 18 years of age). We do not knowingly collect or process Personal Information from children, nor do We encourage children to access or use the Online Store or the Services. We do not accept any responsibility or liability for any use of the Online Store by a person who is a child, or for any resulting claims by their parents or lawful guardians, as applicable

  1. When do We collect Your Personal Information and how do We use the Information We collect?

We will only collect and process Your Personal Information in accordance with applicable laws. We collect and use Your Personal Information by way of the following means:

Directly from You, e.g. when You access or register on the Online Store via the Scapia Platform, when You place an Order for goods listed on the Online Store, when You contact Us for support, or when You engage with any features on the Online Store that require You to provide information. The Personal Information We receive from You in such instances may include Your name, phone number, email ID, delivery address, payment details (such as payment method, UPI ID, or card-related information as applicable), and other information or documentation that may be required from you in connection with the Services. We may also collect Order-specific data such as the items purchased, delivery preferences, communication history with Us or Sellers, and any returns, refunds, or grievance requests You submit. In some instances, We may request access to Your device’s camera, microphone, or storage, for example, where You wish to upload an image as part of a product return or provide a screenshot to assist in resolving a support request.  We may also ask You for certain financial information, including Your bank account details and type, and / or other necessary payment related details or other payment method data (for which We will obtain Your explicit consent in accordance with applicable laws, from time to time, as may be required). We may ask You to provide certain additional information about Yourself on a case-to-case basis, subject to obtaining Your explicit consent, in accordance with and subject to applicable laws.

How do We use this Personal Information: We use the Personal Information collected from You: (i) to facilitate the browsing, selection, ordering, and delivery of goods on the Online Store; (ii) to confirm and process Your Orders and share relevant details with the applicable Seller; (iii) to coordinate delivery through Our delivery partners or those of the Sellers; (iv) to authenticate and verify Your identity for access to the Online Store; (v) to process payments and refunds through authorized third-party payment processors; (vi) to respond to Your queries, complaints, and feedback, and provide You with customer support; (vii) to improve and customize the Online Store experience based on Your usage patterns; (viii) to send You transactional messages, delivery updates, service-related notifications, and, subject to Your preferences, promotional content or marketing material; (ix) to protect the security and integrity of the Online Store and investigate any suspected illegal or unauthorized activity; and (x) to comply with legal obligations or respond to legitimate government requests, enforce Our Terms, and protect Our legal interests.

From time to time, We may share Your Personal Information with third parties, such as payment service providers, delivery partners, customer support vendors, or other business associates involved in enabling the Services. We may also use Your Personal Information to send You service communications relating to Your Orders or the Services, as well as promotional content if You have consented to receive such communications. You may opt out of receiving promotional emails or messages from Us by using the unsubscribe option provided in such communications. However, We may continue to send You essential transactional and service-related communications, such as Order confirmations, delivery alerts, and security updates, as these are necessary to deliver the Services.

  1. Information received with Your permission:

We may collect, store, and monitor certain information from Your device such as camera, microphone, storage access, and location data. The Personal Information We receive with Your permission involves one-time access to Your device’s camera and microphone to facilitate features like product image uploads, voice search, and customer support. We may access to Your device storage to allow uploading or downloading of order-related documents and We may access Your location data to provide accurate delivery services and personalised shopping experiences.

How We use this Personal Information: (i) We use camera and microphone access to enable You to upload photos for returns, verify identity where necessary, or interact with voice-enabled features; (ii) We use storage access to allow You to securely upload and store product images, order invoices, or related documents on Your device for ease of access; (iii) We use location data to improve delivery accuracy, suggest relevant products and offers based on Your geographic location, and enhance overall service quality; (iv) We use these permissions to provide a seamless and customised shopping experience on the Online Store.

  1. Information We generate about You or collect about You:

Location based information: When and if You access or use the Online Store through a mobile or handheld device, We may explicitly seek permissions from You to collect location-related information from such device. This may include location data such as Your current location, postal address, and related device information, including IP address, cookies, and similar technologies that may help identify Your browser or device. This information may be collected and used for purposes such as improving Your browsing experience, supporting location-based search functionality, and for addressing technical issues. This data helps Us enhance the functionality of the Online Store, conduct internal research on Our Users’ demographics and preferences, and improve Our Services. Such third parties are authorised to use Personal Information strictly for purposes such as: (i) fulfilling and delivering Your orders placed on the Online Store; (ii) processing payments and refunds securely; (iii) providing customer service, handling returns, and resolving disputes; (iv) sending order-related updates, confirmations, or service notifications; (v) conducting marketing or promotional activities, where You have provided the relevant consent; (vi) performing audits, data analytics, and Service improvements; and (vii) preventing and detecting fraudulent or illegal activity.

Disclosure during change of control: Based on Your consent, We may share Your Personal Information with Our parent company, subsidiaries, and affiliates as a result of a sale, acquisition, merger, reorganisation, or other change of control. We may also disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of Our membership interests and / or assets or other corporate change, including, during the course of any due diligence process.

Disclosures required by law: We may access, use, preserve, transfer, and disclose Your information (including Personal Information), including disclosure to third parties: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in Our good faith opinion, such disclosure is required or permitted by law; (ii) to protect and / or defend the Terms for any of Our Services or other policies applicable to any of Our Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Services or any third party; and / or (iv) to detect, prevent or otherwise address fraud, security or technical issues. Further, We may use IP addresses or other device identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers, and / or law enforcement agencies, including disclosing such information to third parties, where it is required by law or is in pursuance to any subpoenas, governmental requests, orders from government authorities or investigative agencies, or legal processes requiring the requisite details. Such disclosures may be carried out without notice to You.

We provide You with the following rights about Your Personal Information as per applicable laws. Your rights are:

Right to access information: You have the right to ask Us: (i) for a summary of Your Personal Information being processed by Us and the processing activities undertaken by Us with respect to such Personal Information; (ii) the identities of all other third-party entities with whom Your Personal Information has been shared by Us, along with a description of the Personal Information so shared; and (iii) such other information that may be mandated for us to provide You under applicable law. However, this right has certain limitations as prescribed under applicable law.

  1. Right to modify / rectify information: You have the right to correct or update any information, including Your Personal Information. In the event You notice that any Personal Information already provided by You is inaccurate or incomplete or needs to be updated, You can ask Us to rectify such Personal Information (if the same cannot be done at Your end through the Online Store) by contacting care@safareo.com. Further, if any Personal Information already provided by You is inaccurate, incomplete, or outdated, then You must give Us the accurate, complete, and up-to-date Personal Information by writing to Us at the email ID provided above, and We shall accordingly rectify such Personal Information at Our end. We urge You to ensure that You always provide Us with accurate and correct information / data to ensure that Your use of Our Services is uninterrupted. In case of any such modification of Personal Information, You may be required to furnish supporting documents relating to the change in Personal Information for verification. Any loss or damage accruing due to provision of inaccurate information or failure to update Your details, will be Your sole responsibility, to Our total exclusion.

  1. Right to erasure: You have the right to request the deletion or removal of Your Personal Information where there is no compelling reason for Us to keep it. Such right of erasure can be exercised by writing to Us at care@safareo.com, which must be in a format prescribed by the government, when available. For now, You may write to Us on the above email, to exercise this right. On such an erasure request, We shall delete all of Your Personal Information stored by Us. We shall also ensure that any third-party service provider processing Your Personal Information on Our behalf deletes all Your Personal Information, unless retention of the same is necessary for providing the Services or for compliance with any applicable law for the time being in force. Upon such erasure request being made by You, We will undertake the necessary deletion within a reasonable time and will cease processing Your Personal Information, except as may be permitted under applicable law. Please note that We may not be able to allow You access to Our Website and / or provide Services, subsequent to Your exercising of this right.

  1. Right with respect to consent:  In certain instances, before collecting Your Personal Information, We take Your free, specific, informed, unconditional, unambiguous, and explicit consent. You can deny consent for the use of any particular information or revoke the consent already given. You shall have the following rights about Your Personal Information collected by Us:

  1. Deny Consent: You shall have the right to deny a request for consent for (a) collection and processing of specific Personal Information; (b) processing of Personal Information for specific purposes; (c) disclosure of such Personal Information to any third parties; and (d) retention of such Personal Information (except when the same is required to be retained under applicable laws). However, any such denial will not prejudice Our rights or the rights of Our partners to retain any Personal Information that You have provided in relation to the Services already availed by You through the Online Store, or by any third-party service providers, per the provisions of this Privacy Notice. Further, in case of a denial of a request for consent, the Online Store does not guarantee the continued facilitation of a Service.

Withdraw Consent: You may also choose to withdraw Your consent (including consent provided for the processing of Your Personal Information by Us or by any third party on Our behalf) supplied to the Online Store at any point in time.  To withdraw Your consent for the use, processing, disclosure, sharing or transferring of any Personal Information, You may mail Us at care@safareo.com. However, please note You will not be able to withdraw consent to the collection of necessary cookies, which enables Us to display the Online Store on Your browser. Your withdrawal of the consent will not affect the lawfulness of processing of Personal Information based on Your consent before its withdrawal. In such an event, You are responsible for the consequences of such withdrawal of consent, and We do not provide a guarantee of Services if any such option to withdraw consent is exercised.

If You do not provide Your consent or later withdraw Your consent, We reserve the right not to offer You a Service on the Online Store, if such Personal Information was relevant for provision of the Service and / or Online Store.

In scenarios of withdrawal, We may delete Your Personal Information or other information We had earlier collected and stored, or de-identify it so that it is anonymous and not attributable to You.

Upon receiving a request for deletion of Your Personal Information, or withdrawal of consent for the processing of Personal Information, We shall not retain Your Personal Information if We no longer need it, and there is no legal requirement to retain the same. Do note that multiple legal bases may exist in parallel, and We may still have to retain certain data and information at any time.

  1. Right to nominate: You shall have the right to nominate any other individual, who shall, in the event of Your death or incapacity, exercise Your rights in relation to Your Personal Information, per applicable law in India.

  1. The applicable laws prescribe certain duties that You must adhere to. As part of Your duties, You need to ensure that You:

  1. Adhere to all the applicable laws for the time being in force while exercising Your rights;

  1. Do not impersonate any other person at the time of providing Your Personal Information;

  1. Do not suppress any material information while providing Your Personal Information for any document, unique identifier, proof of identity or proof of address issued by the State or any of its instrumentalities;

  1. Do not register false or frivolous grievances or complaints with Us or the Data Protection Board of India; and

  1. Furnish only verifiably authentic information when exercising Your right to erasure.

  1. Security and Measures

  1. We have reasonable security measures and safeguards in place to protect Your privacy and Personal Information from loss, misuse, unauthorised access, disclosure, destruction, and alteration of the information in compliance with applicable laws.

As long as You access and / or use the Online Store (directly or indirectly), it is Your obligation, at all times, to take adequate physical, managerial, and technical safeguards, at Your end, to preserve the integrity and security of Your data which shall include and not be limited to Your Personal Information.

We or any of Our partners do not assume any liability or responsibility for disclosure of Your Personal Information due to errors in transmission, unauthorised third-party access, or other causes beyond Our reasonable control. You understand and acknowledge that We cannot ensure or warrant the security of any Personal Information You transmit to Us or guarantee that Your Personal Information may not be accessed, disclosed, altered, or destroyed by a breach of any of Our security measures and safeguards. In the event of any actual or suspected security incident, including data breach, We will take all measures required to be undertaken under applicable laws. You play an essential role in keeping Your Personal Information secure. You shall not share Your Personal Information or other security information of Your Account with anyone. We have undertaken reasonable measures to protect Your rights of privacy concerning Your usage of the Online Store controlled by Us and Our Services. However, We shall not be liable for any unauthorised or unlawful disclosures of Your Personal Information made by any third parties who are not subject to Our control. In the event of any actual or suspected security incidents, including data breaches, We will take all measures required to be undertaken under applicable laws.

  1. For how long do We retain Your Personal Information?

We ensure that Your Personal Information, which is in Our possession or under Our control, is destroyed and / or anonymised as soon as, as per applicable law (if mandated), it is reasonable to assume that (i) the purpose for which that Personal Information was collected is no longer being served by the retention of such Personal Information; and (ii) retention is no longer necessary for any other reason including applicable law.

  1. The grievance redressal officer shall acknowledge Your grievances, or complaints or concerns with respect to the Online Store or the Services, within 24 (twenty-four) hours of receipt of the same and shall endeavour to redress the same at the earliest.

  1. If You have exhausted Your opportunity of redressing Your grievances concerning Your Personal Information with Us and You are not satisfied with the resolution, You may raise Your concern to the Data Protection Board of India, once formed and effective.

  1. While You have the right to raise complaints with both the Company and the Data Protection Board of India, please note that, registering false or frivolous complaints with the Data Protection Board is a punishable offence.

  1. Changes to the Privacy Notice

We reserve the right to amend this Privacy Notice from time to time to ensure that this Privacy Notice is consistent with any developments to the Online Store and Services, the way We use Your Personal Information and any changes to the applicable laws including applicable data protection laws. We will make the updated Privacy Notice available on the Online Store. We will notify You of any changes to this Privacy Notice by way of an email.
